Distribution Agreements · glossary
Someone in England who receives court papers on a foreign party’s behalf. Tullavane must appoint one before the deal starts, so court papers can be served in England, not in Dublin. If it does not, Cressby may appoint one at Tullavane’s cost. Agreement, clause 30.2 · Chapter 9 · see Exclusive jurisdiction clause
Explained in Chapter 9, Confidentiality, Data Protection, Assignment and Governing Law, of Distribution Agreements.
A claim in England begins when the court issues the claim form (the court papers). The claim form must then be served on the other side. Serving it in Dublin would take longer. Tullavane must therefore name a process agent, someone in England who takes court papers for it (clause 30.2).Read Chapter 9, Confidentiality, Data Protection, Assignment and Governing Law →
