Entire agreement clause

A clause saying that the papers it names contain the whole agreement. Clause 13 fixes the terms of Frescalva’s contract, not what Marrowby relied on. So it is not a non-reliance clause, and it does not shut out a misrepresentation claim. Conditions of Sale, clause 13 · Chapter 7 · see Misrepresentation

Explained in Chapter 7, Negligence and Misrepresentation: Tort Beside Contract, of English Law Basics.

The main page for this term is Entire agreement clause, in Drafting Skills.

How it comes up, in Chapter 7
Duarte asks whether clause 13 of the Conditions does that job. It is an entire agreement clause: it says the Conditions, the quote and the acknowledgement contain the whole agreement.
