Deemed service

The fixed day on which a document counts as served, whenever it was really read. A claim form sent by email counts as served on the second business day after sending. Every deadline for Corledge’s answer ran from that day. Chapter 3 · see Acknowledgment of service

Explained in Chapter 3, Issuing and Serving the Claim Form, of Civil Litigation.

How it comes up, in Chapter 3
An email does not count as served on the day it is sent. Under CPR 6.14, a claim form counts as served on the second business day after the step that serves it. Here that step is the email. Business days leave out weekends and bank holidays. This fixed day is called deemed service, and it ends any argument about when someone opened the email.
