Break clause

A clause that lets a party end a lease early, on a fixed day, by notice. Clause 10 lets only Linnet break, at year five, on at least six months' notice. The break works only if the Annual Rent is paid and the whole floor is empty on that day. Lease, clause 10 · Chapter 9 · see Break date, Notice (giving a), Time of the essence

Explained in Chapter 9, The Break Clause, and Forfeiture, of Commercial Leases.

How it comes up, in Chapter 9
A break clause lets a party end a lease early, on a fixed day, by giving notice. Linnet's ten-year lease has a break at year five, and only Linnet may use it. The Break Date is also the Review Date, so if Linnet expects the review to raise the rent too far, it can leave instead. It must decide six months ahead, before the new rent is known.
