Module 4 · Chapter 10
Restructuring Effective Date and Recognition Abroad
The court’s order is not the last step. This chapter follows a sanctioned plan to the day it takes effect, and shows why a court abroad should respect it.
In this chapter
- When the court’s order starts to bind every creditor
- What happens on the day the plan takes effect
- Why a court abroad should respect an English plan
10.1The last steps in one paragraph
Sanction does not change any debt by itself. The court’s order binds creditors once it is published, but the plan takes effect on a later day, when all its conditions are met. On that day the Notes are cancelled and the new Notes are issued, with the shares. Valkenrade is a Dutch company, so one question remains: will a court in its home country respect the order?
Key point
The debts change only on the effective date. Until then, the Notes still stand.
