Module 4 · Chapter 10
When an Employee Resigns: Garden Leave and Enforcing the Covenants
When a senior seller resigns to join a rival, the employer keeps her away from its customers in two stages: garden leave while she works her notice, then the restrictions once she has gone.
In this chapter
- Why Cressby keeps a resigning seller on garden leave instead of paying her to go
- How long each restriction runs once garden leave is over
- What to do about a customer list sent home, and how to warn the new employer
10.1A resignation in one paragraph
Two years after she joined, Esme resigns to join a rival. She gives the notice the Contract requires, and Cressby keeps her on garden leave for all of it. When she leaves, the restrictions take over for the months that remain. Marchbank Orme has two more tasks: getting back a customer list she emailed to herself, and reminding her new employer of the restrictions.
Key point
Garden leave and the restrictions work as one plan. Garden leave keeps her away while she is still employed. The restrictions keep her away from Cressby’s customers and team after she has gone.
